Dammit, I want royalties!!!

Ooohh! Here's your chance to sue me for copyright infringement.

But that would be tres Cooganesque. (How's that for Paris-talk?)
I wonder if his legal "wonder team" is able to take my case? I know Dan will put in a good word for me...

Yeah, baby, I'm puttin' it ALL out on the line!
In my case, I was the plaintiff and we prevailed. The judge awarded statutory damages greater than 6 figures -- plus we got costs and attorney fees. I could have had to declare bankruptcy had the process not worked (if the defendant appealed, they could afford to outspend me into oblivion -- that's what I meant by putting it ALL on the line for my principles -- most people are not willing to risk their entire financial future -- but, as Eight6 said "I've put it ALL out on the line for my principles numerous times...many people here have." Maybe I was wrong about him, I'd have to hear more about the numerous times he risked it all.

Of all the people that frequent this site, I'll bet few (if any) have sued and won a copyright case. I did and it took 2 years and 8 months and a lot of money.

Here's a bit of info on copyright law from the RIAA web site for all of you who like to "share" so freely. I am just one photographer with limited resources -- The RIAA and companies (like the one I sued) basically have unlimited resources for this type of thing and can make your life a living hell.

http://www.riaa.com/issues/copyright/laws.asp
No Electronic Theft Law (NET Act) sets forth that sound recording infringements (including by digital means) can be criminally prosecuted even where no monetary profit or commercial gain is derived from the infringing activity. Punishment in such instances includes up to 3 years in prison and/or $250,000 fines. The NET Act also extends the criminal statute of limitations for copyright infringement from 3 to 5 years.

Additionally, the NET Act amended the definition of "commercial advantage or private financial gain" to include the receipt (or expectation of receipt) of anything of value, including receipt of other copyrighted works (as in MP3 trading). Punishment in such instances includes up to 5 years in prison and/or $250,000 fines. Individuals may also be civilly liable, regardless of whether the activity is for profit, for actual damages or lost profits, or for statutory damages up to $150,000 per work infringed.

Again, what of it? Is there some intrinsic value derived from winning a court case? It certainly doesn't appear to have enhanced your standing here.

With respect to Motors: Screw that! I'm voting for Hate6 or Great6, both inspired, as well as being quite true! No way I'm letting "Frenchie" win anything.

You seem so willing share so much Eight6 -- how about telling us about just one of the numerous times you risked it ALL including your entire financial future for your principles?
I didn't post my experience with my copyright lawsuit to enhance my standing here. I posted about it because it was an experience I had (which I hope to never go through again). Many members post about their experiences and this was a huge event in my life which I am happy to be done with -- maybe others can relate to being relieved with the end of a (potentially) life altering event.

Also, with the copyright questions here, I felt my experience was directly relevant to the issue -- sorry to say that there is lots of confusion about copyright from the people here regularly (and most people as well).

You're kidding right? I mean really...do you think that your pedestrian attempts to prod personal information out of me will work? If you want to lay aspects of your life out, go right ahead. I've seen what stupidity like that can do when it comes back to kick your ass. We've ALL seen it.

You're not the only person who owns his own business, you're not the only person with principles and you're not the only person who has made tough & potentially life altering decisions. I have, many times...you can believe what you want. If you choose not to believe, who cares? I owe you nothing in the way of explanation.

And truth be known, if the monies gained by you in the court case covered anything more than your legal fees and the normal fees charged for the items improperly used, then you didn't do it for your priniples, you did it for the money. Right?

A Psychiatric ward, somewhere in Canada

The Psy: So, Eighty something, how do you feel today?
_ Very good, very good Doctor!
_ What did U do today?
_ I polluted many topics of the NWO, I loved it, I loved it!
_ That's nice, what else did U do?
_ I insulted lots of people, French, Filipinos, Hispanic and others I can't recall their nationalities, I hate foreigners.
_ I see that you have found a conduit to release your natural aggressiveness, that's good, we are progressing...
_ Hum...What about this tantrum that U threw this morning, would U like to talk about it?
_ It was about the pancakes!
_ The pancakes?
_ Yes the nurse forgot the maple syrup!
_ Ok, I'll tell the nurse to give U maple syrup tomorrow.
_ Thank you Doc, I love maple syrup, I like to drink it from the bottle!
_ I see... OK I'll talk to you later, I have to attend to my other patients.
_ Bye Doc, thank U for your visit!
I never said I was. I just shared an experience I had, just like others share their experiences -- this was not a light decision to pursue litigation against a huge corporation -- it could have ruined me, but it did not. You seem so quick to criticize, when all I've done is share a bit of what happened to me relating to copyright infringement (an activity you participate in quite blatantly and regularly -- something that I went to Federal court to enforce and spent quite a lot of time money and energy involved in (here's a hint -- the RIAA can come after you for copyright infringment -- though you probably think it can't happen to you)
I didn't make any money from the lawsuit -- it all went to cover the expenses (they had extremely good lawyers, the best money could buy -- i.e. they drag out the process, stalling, delaying, feet dragging, not providing discovery, depositions, transcripts -- and I end up paying for it, replying to motions, hiring expert witnesses, etc, etc, etc... 2 years and 8 months later...)

You can be ethical in business, have principles and still make a profit (the company I sued thought they could get away with it, and they underestimated me) -- that does not mean you don't have the right to protect what is yours. Sometimes it costs a lot to protect your principles (like some people like to say, "Freedom ain't Free") and so is going to Federal Court.

Genius, sheer genius. Does Jerry Lewis play me, or the madcap doctor? Bravo!! C'est Magnifique!!! Fuck, Coogan's Seinfeld posts are more entertaining; although, just slightly.

BTW: you pollute, I enhance. Nice try.

LOL!! And you have been the happy recipient of those shared files. So talk on about copyright infringement, and continue to imply that I am less honorable than you by sharing stuff half the artists can't even remember recording. Again, for those among us who are slower than the rest, obscurities, shared within a reasonably closed loop are not what the RIAA has on the top of their witchhunt list. It's the asshats posting commercially available items that threaten the site.

But feel free to do your Yankee Doodle duty Dan: immediately cease any and all downloads from this site. Then, those 'words from the pulpit' might ring true to the rest of us.

And that's what makes you one of the leeches Dan.

Last time I checked, in Canada, it's illegal to download but not to upload. It goes back to how the laws surrounding blank cassette tape royalties were handled here.

Now if you'll excuse me, I have to go back to sending harassing e-mails to tiger, so he'll share his massive new Italo mp3 collection with me.
